Abstract

This article discusses the process of Islamization and shariahization in Samudera Pasai. Pasai was the first region to be islamized by those who spread Islam from Arabian peninsula. From this region Islam spread throughout Nusantara. Pasai played an important role in Islamizing Nusantara. Based on local and foreign sources as well as the historiography of Pasai, this article tries to elaborate the process of Islamization of Samudera Pasai comprehensively. In terms of shariahization, it is meant as an endeavor to implement Islamic law which was initially identical with Islamization. Based on Ibn Batûtah, a Moroccon traveller, who visited Pasai, it is apparent that some aspects of Islamic law had been implemented and constituted as an integral part of societal and political life in this Muslim kingdom. This article shows that Islamic law had been practiced from the beginning as it went hand in hand with the process of Islamization.

Abstract

This article aims to reveal the values of local wisdom explored from the teachings of the Siddîqîyah order which drives the emergence of high spirit of entrepreneur-ship. The article demonstrates that the spirit of entrepreneur-ship within the Siddîqîyah order is strongly related to its teachings, doctrines and culture, such as that of the unity between faith and humanity, the eight points of readiness for the Siddîqîyah membership, and the doctrine of ‘santri’ (disciple). In attempts to earn living, they run business enterprise through promoting the principle of hard-work and good business management, in addition to implementing spiritual and social capital in achieving success in business. They believe in and feel the strength of prayer (du‘â’), certain rituals, and the importance of belief and harmony to achieve success in business. The teachings, doctrines and culture of the Siddîqîyah order influence the understanding towards the meaning of wealth or property, and occupy an important position in the life of the Siddîqîyah followers. For them, property or wealth has double meaning; it is not only meant in economic context, but also understood in other meanings, i.e., social, spiritual, cultural, and philosophical.

Abstract

Online business (selling-buying) has become prominent in the past few years ago as demand increases. This kind of business forms a positive effect of the development of internet which produces new business-men. Along with the development of online business, there emerges dropship system which is mostly undertaken by female entrepreneurs. Despite its negative effect, dropship system has positive influence, i.e. creating positive activities for women and therefore empowering them. The polemics of dropship is still going on. According to some Muslim jurists, dropship is forbidden (harâm) because the practicioners of this system sell items only from picture. Moreover, the items sold have not been the property of the practicioners. This article deals with the benefit of wakâlah and samsarah contract used to accommodate the dropship system. The specification of both contracts is explained in detail in order for this system to be undertaken as wakalah and samsarah contract. The practicioners of dropship as wâkil, and suppliers as muwakkil, or the practicioners of dropship as simsâr with some conditions that should be accorded to the contract in the beginning of transaction.

Abstract

Discourses on Islamic school curriculum can be divided into theoretical and practical levels. In this paper, the practical level of the curriculum is examined in terms of its philosophical meaning within teachers, the translation of the philosophical view into school curriculum, and what strategy is being used to sharpen the curriculum messages. This article discusses the understanding of the school teachers and administrators towards the specific religious characteristics of public education at Madrasah Aliyah Negeri (MAN) 3 Malang. From the field research, this article finds three important results. First, the educators in MAN 3 Malang perceived their institution as the agent of amalgamation between Pesantren tradition and secular education to uphold excellences in academic and non-academic areas. Second, in order to materialize such philosophical thought, the educa-tors developed and implemented particular schemata. Third, in order to strengthen Islamic characteristics through curriculum development, the school applied the strategy of religious activity, direct monitoring and evaluation, educative activity designs, and implementing school’s vision through strategic platforms.

Abstract

This article seeks to discuss the issue of inheritance in Indonesia and the solution offered through studying the Quranic verses of inheritance according to Abdullah Saeed. Saeed’s methodological approach is used as a tool of analysis to reconstruct the law of inheritance in Indonesia. On the one hand, Saeed’s theory of ‘value hierarchy’ is formulated in order to maintain the principle of Islam’s universality. On the other hand, this theory is applied in order for Islam to be valid for every time and place (sâlih li kull zamân wa makân). Saeed’s theory of ‘value hierarchy’ consists of among others obligatory values, fundamental values, protectional values, implementational values, and instructional values. Based on Saeed’s theory of value hierarchy, the division of inheritance based of customary law (adat) called dumdum kupat (the portion of inheritance for son and that for daughter is the same) is valid and can be applied.

Abstract

This article focuses on the reconstruction of the objective of Islamic education based on transcendent taxonomy. This study is based on the idea that “the objective of Islamic education is to make students good”. The word “good” becomes the key as well as the entrance to formulate the objective of Islamic education by examining the concept of “good” in the Qur’ân. The concept is studied using a model of thematic tafsir (mawdû‘î) approach. Using this approach, the word “good” is sought through three stems, i.e., the words ahsan-yuhsin, saluh-yasluh, and khayr with their various forms and changes in the Qur’ân. The classification of verses uses the theory of taxonomy. This article reveals that the objectives of Islamic education taxonomy can be called the ‘transcendent taxonomy.’ The objectives of Islamic education based on the Qur’an can be classified into three dimensions: ilâhîyah (theocentrism; divinity), insânîyah (anthro-pocentrism; humanity), and kawnîyah (cosmocentrism; naturality).

Abstract

Islamic law consists of a set of norms, principles and rules of law enforcement, dealing with the eradication of corruption. In the history of Islamic law, there have been the theories and principles of Islamic law, such as the theory of jawâbir, zawâjir, and the principle of min ayn lak hâdhâ (known as the reversed evidence) regarding the application of criminal sanctions of corruption. The application of criminal sanctions of corruption in Indonesia, especially with regard to the principle of reversed evidence has not been well-formulated. For the perfection of legislation in combating corruption, it is possible for the Indonesian government to amend the existing legislation, in order to make the country free from corruption. This paper focuses on the study of theoretical contributions on sanctions and the principle of proof evidence in Islamic criminal law to be transformed into criminal sanctions of corruption in Indonesia, which refers to the theory of jawâbir, zawâjir, and the principle of min ayn lak hâdhâ, which had been done previously by the caliph ‘Umar b. al-Khattâb and succeeded in preventing and combating corruption.

Abstract

The aim of the research is to analyze social interactions between teachers and parents during the era of war and peace in Aceh. This study employs qualitative method. During the war, the educational institution was one of the institutions which was affected badly. Social integration was so weak that interactions among parents of students, teachers and students were unstable. Within the war situation, social interactions were badly influenced hatred, suspicion, and revenge. The social interaction outside the school was contagious to that inside the school. But when the peace memorandum was signed on August 15, 2005, between the Indonesian government and Independence Aceh Movement (GAM), social interactions in schools began to show significant changes. When the war ended, people began to interact and socialize in good faith. Social interactions involving parents of students and teachers were also changing towards social stability and harmony so that they could inter-act without the feelings of fear, suspicion and revenge. Peace accord means that the enmity has significantly reduced. Hence, the teachers are effectively playing their fundamental role in teaching and socializing the younger generation of Acehnese.

Abstract

This article seeks to find out the intersection between scientific approach and Islamic religious education as a subject matter. The scientific approach adopts scientific steps in building scientific knowledge, i.e. such featuring dimensions as observation, reasoning, inquiry, validation anD and description of scientific truth. Since the scientific approach is regarded as too empirical, rational and logical. In Cartesian sense, it contradicts the logical structure of the subject of Islamic religious education. Five aspects of Islamic religious education (the Qur’ân, Hadîth, Aqîdah Akhlaq, Fiqh, history of Islamic culture, and Arabic language) have different characteristics, even demand a non-scientific logics such as intuition and revelation. Aqîdah (belief), for example, which consists of the doctrine of monotheism (tawhid) is difficult to be scrutinized through empirical evidence. There are some other examples in this field which are difficult to be analyzed by means of scientific approach. Through library research, this article nevertheless finds that the logic of scientific approach and Islamic religious education can be integrated, since revelation and reason are mutually supportive.

Abstract

This article concerns with the interpretation of the Quranic verses on dhikr (rememberance) in their various forms and contexts. It seeks to explore a great variety of exegesis (tafsîr) literature written by Indonesian exegetes such as Mahmud Yunus, Hasby ash-Shiddieqy, Hamka and M. Quraish Shihab. Using the method of comparative exegesis (tafsîr muqârin), this article aims to reveal how these Indonesian exegetes (mufassirûn) interprete the verses of dhikr. The understanding of Indonesian exegetes towards dhikr varies greatly, causing difference in interpreting the verses. However, the exegetes share the understanding that dhikr is an activity of remembering God, spelling out the names of God orally, and actualizing God’s teachings physically. Despite the fact that those exegetes shares commonalities in interpreting the verses of dhikr, they are also different to one another especially in dealing with their perspectives such as historical contexts and language aspects.
